1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the RAZICE websites, applications, QR-enabled products, emergency information services and related services (collectively, the “Services”). By accessing or using the Services, creating an account, registering a RAZICE product or otherwise using RAZICE, you agree to these Terms.
2. About RAZICE
RAZICE provides technology designed to help make important identification, medical and emergency contact information available when it may be needed. RAZICE may provide physical products, including QR-enabled tags, bracelets, cards or similar items, together with online services that allow authorised information to be accessed by scanning or otherwise interacting with those products.
References to “RAZICE”, “we”, “us” or “our” refer to the legal entity operating the RAZICE service.
3. Eligibility and Accounts
You may be required to create an account to use certain Services. You agree to provide accurate, current and complete information and to keep it reasonably up to date. You are responsible for maintaining the confidentiality of your account credentials and must notify us promptly if you reasonably believe they have been compromised.
4. Emergency Information Service
RAZICE enables users to store and make selected information available through QR codes or other identifiers. Depending on the user's configuration, this may include name and identification information, emergency contacts, allergies, medical conditions, medications, blood group, relevant medical history and other information selected by the user.
The account holder is responsible for ensuring, to the extent reasonably possible, that information supplied to RAZICE is accurate and kept up to date.
5. RAZICE Is Not an Emergency Medical Service
RAZICE is an information and technology service. RAZICE does not provide medical diagnosis, medical treatment, emergency medical services, ambulance services or professional medical advice. Information accessed through RAZICE is intended to assist authorised persons, emergency responders, healthcare professionals or others who may need relevant information. It is not a substitute for professional judgement, established emergency procedures, medical examinations or other appropriate sources of information.
6. No Guarantee of Availability or Use in an Emergency
RAZICE is designed to improve access to information, but we cannot guarantee that information will always be available or accessed during an emergency. Access may be affected by internet connectivity, device availability, QR code damage, equipment failure, third-party infrastructure, telecommunications outages, maintenance, cybersecurity incidents or circumstances beyond our reasonable control.
We cannot guarantee that an emergency responder, healthcare professional or other person will scan a RAZICE product, access a profile, rely upon information contained in it, or take any particular action. Users should not rely on RAZICE as their only method of communicating critical medical or emergency information.
7. Accuracy of User Information
RAZICE generally relies upon information supplied by users, account holders and authorised organisations and, unless expressly stated otherwise, does not independently verify medical, identification or emergency information submitted to the platform. Users are responsible for reviewing and correcting inaccurate, incomplete or outdated information.
8. QR Codes and RAZICE Products
Users must not intentionally copy, alter, interfere with, counterfeit, manipulate or misuse a RAZICE QR code, identifier or product. A QR code should be treated as potentially accessible to anyone who physically encounters it. Users should carefully consider what information they choose to make available through a publicly scannable profile.
9. Privacy and Personal Information
RAZICE processes personal information in accordance with applicable data protection legislation and our Privacy Policy. This may include sensitive information relating to health or medical circumstances. Where consent is required by law for a particular processing activity, we will seek that consent where appropriate.
10. Information About Other People
You may only submit personal information about another person where you are legally entitled to do so, including where you are a parent, legal guardian, authorised representative or otherwise have an appropriate lawful basis.
11. Children and Dependants
RAZICE may allow parents, guardians or other authorised persons to manage information relating to children or dependants. The person creating or managing such a profile represents that they have the necessary authority to do so. We may require additional verification or consent where required by law.
12. Acceptable Use
You may not use RAZICE for unlawful, fraudulent or deceptive purposes; impersonate another person; submit information you know to be materially false; gain unauthorised access to information; circumvent security controls; introduce harmful code; interfere with the Services; harvest information without permission; or infringe another person's privacy, intellectual property or other rights.
13. Purchases and Payments
Where paid products or Services are offered, applicable prices and material terms will be displayed before the transaction is completed. Payments may be processed by third-party payment providers whose terms and privacy policies may also apply.
14. Delivery
Where physical products are purchased, estimated delivery times and applicable charges will be communicated during the purchase process or otherwise made available before completion of the transaction. Delivery estimates are estimates unless expressly stated otherwise.
15. Cancellations, Returns and Refunds
Cancellation, return and refund rights will be provided in accordance with applicable South African law, including the Consumer Protection Act and Electronic Communications and Transactions Act where applicable. Nothing in these Terms is intended to exclude a consumer right that cannot lawfully be excluded.
16. Intellectual Property
The RAZICE name, branding, software, website, designs, graphics, databases, documentation, QR systems and other materials provided by RAZICE are owned by or licensed to RAZICE and may be protected by intellectual property laws. These Terms do not transfer ownership of RAZICE intellectual property to you.
17. User Content
You retain ownership of information and content you submit, subject to third-party rights. You grant RAZICE the limited rights necessary to host, process, transmit, display, back up and otherwise handle that content to provide and secure the Services and comply with law. Personal information remains subject to our Privacy Policy and applicable data protection law.
18. Third-Party Services
The Services may rely upon third-party hosting, telecommunications, email, payment or other technology providers. RAZICE is not responsible for third-party services to the extent that relevant circumstances are outside our reasonable control, subject to rights that cannot lawfully be excluded.
19. Security
RAZICE takes reasonable technical and organisational measures intended to protect information and operation of the Services. However, no internet-connected service can guarantee absolute security. Users must take reasonable steps to protect their accounts, passwords, devices and credentials.
20. Service Changes and Availability
We may modify, maintain, update or improve the Services and may temporarily suspend portions where reasonably necessary for maintenance, security, legal compliance or technical reasons.
21. Limitation of Liability
To the maximum extent permitted by applicable law, RAZICE will not be liable for losses caused solely by circumstances outside its reasonable control or by inaccurate information supplied by a user or third party. RAZICE does not guarantee that use of the Services will prevent injury, illness, death or any other adverse event. Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including liability for gross negligence where such exclusion is prohibited.
22. Indemnity
To the extent permitted by law, you agree to indemnify RAZICE against third-party claims arising directly from your unlawful or intentional misuse of the Services, infringement of another person's rights, or submission of information about another person without required authority. This does not limit statutory consumer rights.
23. Suspension and Termination
We may suspend or terminate access where reasonably necessary because of a material violation of these Terms, fraud or suspected unlawful activity, a material security threat, misuse of another person's information, legal requirements or conduct materially threatening RAZICE, its users or third parties.
24. Changes to These Terms
We may update these Terms to reflect changes to the Services, applicable law, security requirements or business operations. The current version will be published with its last-updated date. Where material changes affect existing users, notice will be provided where required by law.
25. Electronic Communications
By using RAZICE, you agree that account and service communications may be provided electronically, subject to applicable law. Marketing communications will be handled separately in accordance with applicable consent and opt-out requirements.
26. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Disputes will be dealt with in accordance with applicable South African law and the jurisdiction of competent South African courts, without limiting a consumer's right to approach a regulator, ombud, tribunal or other body having jurisdiction.
27. Consumer Rights
Nothing in these Terms is intended to waive, restrict or exclude any right or remedy that cannot lawfully be waived, restricted or excluded. Applicable legislation prevails to the extent of any conflict.
28. Severability
If any provision is found unlawful or unenforceable, it will be interpreted or limited to the extent necessary to make it enforceable where legally possible, and the remaining provisions will continue to apply.
29. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms expressly applicable to a particular product or Service, constitute the agreement governing your use of RAZICE.
